Terms of use Think Build Deploy

Please read these terms of use carefully before using Think Build Deploy. By accessing and using our web platform and related services, you agree to be subject to these Terms. If you do not agree with any of these terms, do not use our tool.

Use of the Platform

Our platform is designed to provide tools and resources for the creation of e-learning content. By using our platform, you agree to comply with all applicable laws and regulations, as well as these Terms.

Registration and User Accounts

To access certain functions of our platform, it may be necessary to create a user account. You are responsible for maintaining the confidentiality of your account and password, and agree to notify us immediately of any unauthorized use of your account.

Intellectual Property

All intellectual property rights over our platform and its content, including, among others, copyright, trademarks, patents and trade secrets, are property of OpenSky Information S.A.S. or its licensors. You agree not to copy, modify, distribute, transmit, display, reproduce, publish, license, create derivative works, transfer or sell any content of our platform without our prior written consent.

User Content

You retain all ownership rights over the content you create or upload to our platform (“User Content”), including projects, text, images, videos, PDFs, interactive components and AI-assisted drafts. By uploading or creating User Content, you grant OpenSky Information S.A.S. a limited, worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, reproduce, adapt, display, distribute and publish User Content solely as necessary to operate, maintain, secure and improve the platform and provide the contracted services, including publishing, SCORM export, embedding, LTI delivery and analytics.

You represent and warrant that: (i) you own User Content or have all necessary rights, licenses and permissions to upload, use and publish it; (ii) User Content does not infringe any third party's copyright, trademark, patent, trade secret, privacy, publicity or other rights; (iii) you will comply with applicable law when creating and distributing educational content; and (iv) you will pay all royalties or fees owed because of User Content.

Copyright and third-party materials

Think Build Deploy is an authoring and hosting tool. We do not verify the copyright status of materials you upload, search for or share. You are solely responsible for ensuring that all images, videos, PDFs, audio, text and other materials included in your projects are legally authorized for your intended use, including educational, commercial or internal distribution.

This responsibility applies to media uploaded to the Deploy Plan file library, interactive videos, files linked through the PDF viewer and Files components, content published via embed codes, SCORM packages exported on the Build or Deploy Plans, and images or videos obtained through the Unsplash media search. When using Unsplash or other third-party stock media, you must comply with the applicable license terms, including attribution and permitted uses.

OpenSky Information S.A.S. is not liable for copyright or other intellectual property violations arising from User Content. We act solely as a technical intermediary for storage and delivery of content you choose to upload or publish.

Acceptable use

You agree not to upload, create, generate, publish or share content that:

Infringes copyright, trademark or other intellectual property rights of third parties.

Violates privacy, publicity or personality rights of third parties.

Contains malware or unauthorized personal data of third parties without a legal basis.

Is unlawful, defamatory, discriminatory, or promotes violence or illegal activity.

Misrepresents authorship or falsely implies endorsement by OpenSky Information S.A.S.

We are not obligated to monitor User Content but reserve the right to remove or restrict access to content that we reasonably believe violates these Terms or applicable law, or in response to valid rights-holder notices. Failure to act in a particular instance does not waive our right to enforce these Terms.

Copyright infringement policy

OpenSky Information S.A.S. respects intellectual property rights. If you believe content on our platform infringes your copyright, send a written notice to info@thinkbuildeploy.com including: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and its location on our platform; (4) your contact information; (5) a statement of good-faith belief that the use is not authorized by the rights holder, its agent or the law; and (6) a statement, under penalty of perjury, that you are authorized to act on behalf of the rights holder.

Upon receipt of a valid notice, we may remove or disable access to the reported content and notify the affected user. Repeat infringers may have their accounts suspended or terminated. This procedure is without prejudice to rights and remedies available under Colombian law, including Law 23 of 1982 and Andean Community Decision 351, and other applicable jurisdictions.

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless OpenSky Information S.A.S., Think Build Deploy and their directors, employees, affiliates and service providers from any claim, loss, liability, damage, cost or expense, including reasonable legal fees, arising from: (a) your User Content; (b) your use of the platform; (c) alleged infringement of third-party rights by your content; (d) your use of AI-generated content without adequate review; or (e) your breach of these Terms.

AI content generation (beta — Deploy Plan)

The Deploy Plan includes AI-assisted content generation, currently offered as a beta feature. You provide a topic and parameters; the system applies instructional design rules, including the ADDIE model (Analysis, Design, Development, Implementation and Evaluation), to produce draft educational content structured with Think Build Deploy components.

Ownership and use

Subject to applicable law and the licenses of any third-party AI providers we use, you retain ownership of AI-generated drafts incorporated into your projects. You may edit, combine, publish and distribute such content as part of your educational materials, provided you comply with these Terms and applicable law.

Your responsibility

AI output may contain errors, omissions or outdated information. You must review, edit, validate and approve all AI-generated content before publishing or using it in an educational context. You are solely responsible for the accuracy, legality, pedagogical suitability and compliance of published content. Think Build Deploy does not guarantee that AI output is correct, complete, current or free from third-party rights.

No uniqueness guarantee

Similar or identical output may be generated for other users. Your rights in AI output may not be exclusive against third parties.

Beta status

This feature may be modified, limited or discontinued without notice. It is provided “as is” without warranties of accuracy, completeness or fitness for a particular teaching purpose.

Compliance

You must comply with applicable laws on AI disclosure, academic integrity and data protection in your institution or jurisdiction. Where required by law or institutional policy, inform learners that AI was used in content preparation.

Restrictions

Do not use AI features to intentionally generate content that infringes third-party rights, impersonates individuals without consent, or violates applicable law. We do not use your inputs or project content to train third-party generative AI models except as strictly necessary to provide the service under our agreements with providers.

Deploy Plan: media library and uploads

Deploy Plan subscribers may upload images, videos and PDFs (up to 3 GB total storage) and use interactive video (up to 500 MB per file). You represent that you have the right to upload and distribute each file in your educational projects. OpenSky Information S.A.S. does not acquire ownership of your uploaded files and does not screen them for copyright compliance before storage or publication.

Unsplash media search (Build Plan and above)

Think Build Deploy includes a smart search bar connected to Unsplash that helps you find images and videos to use as resources in your e-learning projects. This integration is subject to the Unsplash License, Unsplash Terms & Conditions and Unsplash API Terms, which apply in addition to these Terms.

License and ownership

Photos and videos made available through Unsplash are licensed to you under the Unsplash License for use in your projects, subject to Unsplash's terms. Think Build Deploy and OpenSky Information S.A.S. do not claim ownership of Unsplash content. Unsplash photographers retain their rights; Unsplash grants usage rights under its license model.

How media is incorporated

Selected Unsplash media is generally incorporated into projects using URLs (links) returned by Unsplash, in accordance with Unsplash API guidelines, rather than by copying files to our servers. You must not circumvent Unsplash requirements by re-hosting, proxying or stripping metadata from Unsplash URLs outside the uses permitted by the Unsplash API Terms, unless you have separately obtained rights to do so (for example, by uploading your own licensed copy on the Deploy Plan).

Attribution

Notwithstanding the general Unsplash License, the Unsplash API Terms require attribution when media is displayed through application interfaces we control, including search results and selection previews. Think Build Deploy displays credit to Unsplash and the photographer, with a link to the photographer's Unsplash profile, where required by Unsplash.

When you publish, export or distribute projects (online links, SCORM packages, embed codes, LTI delivery or other channels), you are responsible for preserving any attribution required by Unsplash and for not removing photographer or Unsplash credits that the platform includes in your content.

Download and interaction events

When you select Unsplash media or perform a comparable download-like action in the tool, we notify Unsplash through the mechanisms required by its API guidelines. Unsplash may record Image Interaction Data (such as views, searches and downloads) associated with those URLs to measure usage, support photographers and ensure API compliance.

Prohibited uses

You must not use Unsplash content in a way that suggests sponsorship or endorsement by Unsplash; remove required proprietary notices; aggregate Unsplash content with third-party media so that users cannot attribute it to Unsplash; use Unsplash trademarks in a misleading manner; or use Unsplash content in violation of the Unsplash License, API Terms or applicable law, including machine-learning or biometric-identification uses not authorized by Unsplash.

No warranty

We do not guarantee that every Unsplash search result is suitable for your educational purpose or free from restrictions beyond those described in Unsplash's terms. You remain solely responsible for the final use of Unsplash media in your published content and for compliance with your institution's policies.

Limitation of Liability

To the maximum extent permitted by law, Think Build Deploy, its directors, employees, affiliates, agents, contractors, service providers and licensors will not be liable for indirect, incidental, special, consequential or punitive damages, including, among others, loss of profits, data, use, goodwill or other intangible losses resulting from your access or use of our platform, your User Content, third-party claims related to copyright or other intellectual property, or your reliance on AI-generated content without independent review.

Modifications to the Terms

We reserve the right to modify these Terms at any time. You will be notified of any changes by posting the revised Terms on our platform. Continued use of our platform after such modifications constitutes your acceptance of the revised Terms.

Applicable Law

These Terms will be governed and interpreted in accordance with the laws of the Republic of Colombia, without regard to its principles of conflict of laws.

Plans and Subscriptions

Think Build Deploy offers different subscription plans with specific functionalities and limitations. Each plan has a defined duration, generally monthly, and access begins from the moment of purchase, unless otherwise specified.

Plan Change ("Upgrade" or "Downgrade")

Users can change their plan at any time. However, the handling of the remaining time from the previous plan will depend on the type of change made, according to the following policy:

1. Upgrade to a higher plan

When a user upgrades to a higher plan, the new plan takes effect immediately.

The remaining time from the previous plan is not accumulated, not prorated, and is not converted into additional days.

The remaining time from the previous plan is paused and preserved, recorded as "pending time".

Once the full period of the new higher plan has ended, the system will automatically reactivate the pending time from the previous plan, which will be available until it is exhausted.

The user understands and accepts that this pending time corresponds to the functionalities of the previous plan, not the higher plan.

2. Change to a lower plan (downgrade)

When a user decides to change to a lower plan, the modification will be applied at the end of the current plan's active period.

No refunds, compensations, or prorations will be made for price differences between plans.

Institutional plan (businesses and educational institutions)

Think Build Deploy offers an institutional plan for organizations that require a minimum of ten (10) user seats. This plan is not purchased through the online payment gateway used for individual Build or Deploy subscriptions; commercial terms, pricing, and volume discounts are agreed directly with OpenSky Information S.A.S. through a custom quote.

When requesting the institutional plan, the organization will designate one or more authorized contacts for negotiation, license activation, billing, and support. The institutional agreement may include terms different from the self-service plans described in this section, including billing cycles, renewal, confidentiality, and administrator responsibilities for their users' accounts.

Prices published on the website for individual plans are indicative and do not bind the institutional plan. Any applicable discount will depend on the number of seats, the base plan contracted (Build or Deploy), and the conditions agreed in writing.

Cancellation

Cancellation of a subscription prevents future charges, but does not grant the right to partial or full refund for unused periods.
