Use of the Platform

Our platform is designed to provide tools and resources for the creation of e-learning content. By using our platform, you agree to comply with all applicable laws and regulations, as well as these Terms.

Registration and User Accounts

Access to certain functions of our platform requires an account. Ordinary access is by a link sent to your email or with a Google account. You are responsible for keeping control of that email or Google account, and you agree to notify us immediately of any unauthorized use. Some internal or demo accounts may ask for a password; that method is not the general user login.

Intellectual Property

All intellectual property rights over our platform and its content, including, among others, copyright, trademarks, patents and trade secrets, are property of OpenSky Information S.A.S. or its licensors. You agree not to copy, modify, distribute, transmit, display, reproduce, publish, license, create derivative works, transfer or sell any content of our platform without our prior written consent.

User Content

You retain all ownership rights over the content you create or upload to our platform (“User Content”), including projects, text, images, videos, PDFs, interactive components and AI-assisted drafts. By uploading or creating User Content, you grant OpenSky Information S.A.S. a limited, worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, reproduce, adapt, display, distribute and publish User Content solely as necessary to operate, maintain, secure and improve the platform and provide the contracted services, including publishing, SCORM export, embedding, LTI delivery and analytics.

You represent and warrant that: (i) you own User Content or have all necessary rights, licenses and permissions to upload, use and publish it; (ii) User Content does not infringe any third party's copyright, trademark, patent, trade secret, privacy, publicity or other rights; (iii) you will comply with applicable law when creating and distributing educational content; and (iv) you will pay all royalties or fees owed because of User Content.

Shared projects

The owner of a project on the Deploy Plan may invite collaborators by email, with the permissions View only, Edit components, or Edit project options. A collaborator does not need the Deploy Plan to accept and work within the permission granted.

The project owner is the final legal party responsible for content published or edited in that project, even when the changes are made by an invited collaborator. The collaborator is also responsible for content they themselves create or upload. Only the owner manages invitations, revocations and deletion of the project.

Copyright and third-party materials

Think Build Deploy is an authoring and hosting tool. We do not verify the copyright status of materials you upload, search for or share. You are solely responsible for ensuring that all images, videos, PDFs, audio, text and other materials included in your projects are legally authorized for your intended use, including educational, commercial or internal distribution.

This responsibility applies to media uploaded to the Deploy Plan file library, interactive videos, files linked through the PDF viewer and Files components, content published via embed codes, SCORM packages exported on the Build or Deploy Plans, and images or videos obtained through the Pexels media search. When using Pexels or other third-party stock media, you must comply with the applicable license terms, including any attribution the platform displays and the permitted uses.

OpenSky Information S.A.S. is not liable for copyright or other intellectual property violations arising from User Content. We act solely as a technical intermediary for storage and delivery of content you choose to upload or publish.

Acceptable use

You agree not to upload, create, generate, publish or share content that:

• Infringes copyright, trademark or other intellectual property rights of third parties.
• Violates privacy, publicity or personality rights of third parties.
• Contains malware or unauthorized personal data of third parties without a legal basis.
• Is unlawful, defamatory, discriminatory, or promotes violence or illegal activity.
• Misrepresents authorship or falsely implies endorsement by OpenSky Information S.A.S.

We are not obligated to monitor User Content but reserve the right to remove or restrict access to content that we reasonably believe violates these Terms or applicable law, or in response to valid rights-holder notices. Failure to act in a particular instance does not waive our right to enforce these Terms.

Copyright infringement policy

OpenSky Information S.A.S. respects intellectual property rights. If you believe content on our platform infringes your copyright, send a written notice to info@thinkbuildeploy.com including: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and its location on our platform; (4) your contact information; (5) a statement of good-faith belief that the use is not authorized by the rights holder, its agent or the law; and (6) a statement, under penalty of perjury, that you are authorized to act on behalf of the rights holder.

Upon receipt of a valid notice, we may remove or disable access to the reported content and notify the affected user. Repeat infringers may have their accounts suspended or terminated. This procedure is without prejudice to rights and remedies available under Colombian law, including Law 23 of 1982 and Andean Community Decision 351, and other applicable jurisdictions.

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless OpenSky Information S.A.S., Think Build Deploy and their directors, employees, affiliates and service providers from any claim, loss, liability, damage, cost or expense, including reasonable legal fees, arising from: (a) your User Content; (b) your use of the platform; (c) alleged infringement of third-party rights by your content; (d) your use of AI-generated content without adequate review; or (e) your breach of these Terms.

AI content generation (beta — Deploy Plan)

The Deploy Plan includes AI-assisted content generation, currently offered as a beta feature. You provide a topic, documents and parameters; the system produces draft educational content structured with Think Build Deploy components, using the modalities in the form, including curricular design, microlearning and the other available options.

Ownership and use

Subject to applicable law and the licenses of any third-party AI providers we use, you retain ownership of AI-generated drafts incorporated into your projects. You may edit, combine, publish and distribute such content as part of your educational materials, provided you comply with these Terms and applicable law.

Your responsibility

AI output may contain errors, omissions or outdated information. You must review, edit, validate and approve all AI-generated content before publishing or using it in an educational context. You are solely responsible for the accuracy, legality, pedagogical suitability and compliance of published content. Think Build Deploy does not guarantee that AI output is correct, complete, current or free from third-party rights.

No uniqueness guarantee

Similar or identical output may be generated for other users. Your rights in AI output may not be exclusive against third parties.

Beta status

This feature may be modified, limited or discontinued without notice. It is provided “as is” without warranties of accuracy, completeness or fitness for a particular teaching purpose.

Compliance

You must comply with applicable laws on AI disclosure, academic integrity and data protection in your institution or jurisdiction. Where required by law or institutional policy, inform learners that AI was used in content preparation.

Restrictions

Do not use AI features to intentionally generate content that infringes third-party rights, impersonates individuals without consent, or violates applicable law. We do not use your inputs or project content to train third-party generative AI models except as strictly necessary to provide the service under our agreements with providers.

Usage quotas

The AI engine is included in the Deploy Plan and subject to calendar-month quotas, which renew at the start of the next month. Under the current configuration those quotas are up to 800,000 tokens per month for text processes and up to 5 USD accumulated per month for AI image generation. The Think and Build plans do not include an AI quota.

If you exceed either quota, new AI generation is blocked until the next cycle. The rest of the editor, without AI, remains available. The server applies the exact values; if the platform updates them, the limit shown in your profile under AI usage prevails.

Prompts are processed through external providers, including OpenAI and DeepSeek, under their own terms and privacy policies. OpenSky Information S.A.S. may change the model or provider without notice. Pexels media search does not consume these quotas.

Deploy Plan: media library and uploads

Deploy Plan subscribers may upload files to the My resources library, with up to 3 GB of total storage. You represent that you have the right to upload and distribute each file in your educational projects. OpenSky Information S.A.S. does not acquire ownership of your files and does not screen them for copyright compliance before storage or publication.

Per-file limits

In addition to the 3 GB cap, each upload is subject to the limit of the flow you use, under the current configuration:

• Images in My resources: 6 MB per file.
• PNG or JPG images uploaded from image search: 5 MB per file.
• Icons: SVG up to 1 MB; PNG or JPG up to 2 MB.
• PDF in the PDF viewer: 100 MB per file.
• Interactive video in MP4: 500 MB per file.

If the application rejects a file, that rejection prevails. These caps may change; the effective limit is the one the product applies at the time of upload.

Leaving the Deploy Plan

The library and new uploads require an active Deploy Plan. If the account moves to Think or Build, the subscription is cancelled, or it is suspended, new uploads and Deploy-only library features are no longer allowed. Files already stored are not deleted automatically on the day of the change. Indefinite retention is not guaranteed: OpenSky Information S.A.S. may restrict access and, after notice to the account email, delete those files. As of the date of these Terms, there is no automatic deletion with a fixed number of grace days. You should export or delete what you wish to keep before leaving the plan.

Pexels media search (Build Plan and above)

Think Build Deploy includes a stock image and video search connected to Pexels. This integration is subject to the Pexels License and the Pexels Terms of Service, which apply in addition to these Terms. Stock search does not consume the AI image quota.

License and ownership

Photos and videos made available through Pexels are offered to you under the Pexels License for use in your projects, subject to Pexels' terms. Think Build Deploy and OpenSky Information S.A.S. do not claim ownership of that content. Authors retain their rights; Pexels grants use under its license.

How media is incorporated

Selected Pexels media is usually incorporated into projects using the URLs returned by Pexels, rather than by copying the file to our servers. If you confirm a stock video to store it in the Deploy Plan library, that file does count toward your storage quota. You must not circumvent Pexels' conditions by re-hosting or altering the media beyond what its license allows, unless you have separately obtained the corresponding rights.

Attribution

When you select Pexels media, the platform displays a credit to the author, with the text “Image taken by” (or the equivalent in the interface language) and, when available, a link to the author's profile. You are responsible for keeping that credit when you publish, export or distribute the project (online link, SCORM package, embed code, LTI delivery or another channel) and for not removing it.

Prohibited uses

You must not use Pexels content in a way that suggests sponsorship or endorsement by Pexels or the author, sell unmodified copies of the photos or videos, or use them in violation of the Pexels License, its terms or applicable law.

No warranty

We do not guarantee that every result is suitable for your educational purpose or free from restrictions other than those in the Pexels license. You remain solely responsible for the final use in published content and for compliance with your institution's policies.

Learner data

Learner authentication (name, or email with a verification code) and the recording of analytics and assessment results process data of people who open published content. For that processing, the author or institution that publishes the project acts as the data controller. OpenSky Information S.A.S. acts only as the data processor, to host the content and provide the contracted service.

The author or institution must have the prior authorization or other lawful basis required by applicable law to collect names, email addresses and assessment metrics, and must inform learners of that use. In an LTI launch, the campus already identifies the learner; this clause also covers that identifier when it is processed to deliver the content or the analytics.

LMS, LTI, webhook and SCORM integrations

The customer or institution is responsible for safeguarding LTI credentials (Consumer Key and Shared Secret), for configuring its LMS, webhooks and organizational network, and for not disclosing those keys. OpenSky Information S.A.S. is not responsible for failures in the receipt or synchronization of grades, or for delivery of a SCORM package or embedded content, when the cause is downtime of the user's LMS, misconfiguration of the webhook or the keys, or a network failure outside the platform.

Limitation of Liability

To the maximum extent permitted by law, Think Build Deploy, its directors, employees, affiliates, agents, contractors, service providers and licensors will not be liable for indirect, incidental, special, consequential or punitive damages, including, among others, loss of profits, data, use, goodwill or other intangible losses resulting from your access or use of our platform, your User Content, third-party claims related to copyright or other intellectual property, or your reliance on AI-generated content without independent review.

Modifications to the Terms

We reserve the right to modify these Terms at any time. You will be notified of any changes by posting the revised Terms on our platform. Continued use of our platform after such modifications constitutes your acceptance of the revised Terms.

Applicable Law

These Terms will be governed and interpreted in accordance with the laws of the Republic of Colombia, without regard to its principles of conflict of laws.

Plans and Subscriptions

Think Build Deploy offers different subscription plans with specific functionalities and limitations. Each plan has a defined duration, generally monthly, and access begins from the moment of purchase, unless otherwise specified.

Plan Change ("Upgrade" or "Downgrade")

Users can change their plan at any time. However, the handling of the remaining time from the previous plan will depend on the type of change made, according to the following policy:

1. Upgrade to a higher plan

When a user upgrades to a higher plan, the new plan takes effect immediately.

The remaining time from the previous plan is not accumulated, not prorated, and is not converted into additional days.

The remaining time from the previous plan is paused and preserved, recorded as "pending time".

Once the full period of the new higher plan has ended, the system will automatically reactivate the pending time from the previous plan, which will be available until it is exhausted.

The user understands and accepts that this pending time corresponds to the functionalities of the previous plan, not the higher plan.

2. Change to a lower plan (downgrade)

When a user decides to change to a lower plan, the modification will be applied at the end of the current plan's active period.

No refunds, compensations, or prorations will be made for price differences between plans.

Institutional plan (businesses and educational institutions)

Think Build Deploy offers an institutional plan for organizations that require a minimum of ten (10) user seats. This plan is not purchased through the online payment gateway used for individual Build or Deploy subscriptions; commercial terms, pricing, and volume discounts are agreed directly with OpenSky Information S.A.S. through a custom quote.

When requesting the institutional plan, the organization will designate one or more authorized contacts for negotiation, license activation, billing, and support. The institutional agreement may include terms different from the self-service plans described in this section, including billing cycles, renewal, confidentiality, and administrator responsibilities for their users' accounts.

Prices published on the website for individual plans are indicative and do not bind the institutional plan. Any applicable discount will depend on the number of seats, the base plan contracted (Build or Deploy), and the conditions agreed in writing.

Cancellation

Cancellation of a subscription prevents future charges, but does not grant the right to partial or full refund for unused periods.
